Wyoming Department of Environmental Quality (WDEQ)
EPA designated Chautauqua County in Jamestown, NY as marginal nonattainment for ozone. The counties of Bronx, Kings, Nassau, New York, Queens, Richmond, Rockland, Suffolk and Westchester are classified as moderate nonattainment for ozone. The county of New York is assigned as moderate nonattainment for PM10.
New or modified major facilities in nonattainment areas must obtain ERCs to satisfy the offset ratio requirements for proposed emission increases. The offset ratios for marginal nonattainment area for ozone are 1.1 to 1 and 1.15 for moderate nonattainment for ozone. That means if 100 tpy of VOCs are emitted from a proposed new or modified major facility in the marginal nonattainment county of Chautauqua in Jamestown, NY, the facility must obtain 110 tpy of ERCs to offset the increase in VOC emissions.
On the other hand, for 100 tpy of VOC emitted from a proposed new or modified major facility in the moderate nonattainment areas identified above, the facility must obtain 115 tpy of ERCs to offset the increase in VOC emissions. Offsets for 100 tpy of PM10 emissions of a facility located in New York County would also need 115 tpy of PM10 since the area is designated as moderate nonattainment for PM10.
